Natural law as a discipline was definitively institutionalized at universities in the Habsburg monarchy during the reforms of Maria Theresia after 1752. The guiding principles of these reforms were set in the instruction for the chair of natural law in Vienna which was given to Carl Anton Martini. It was Catholic in conception, but it ordered the professor to draw on Grotius. Our article reconstructs the elementary structure of Martini’s theory of natural law with a focus on (...) his conception of state. The article proves that Martini did not adopt Wolff’s conception of deducing duties and obligations from the highest principle for that would conflict with the Catholic emphasis on freedom of will. Instead of that, Martini derived duties and rights from the three God-given ends. Martini perceived the state as based on social contract, after the model of Christian Wolff. However, it seems that Martini rejected the two-contract model and acknowledged only the contract of submission as binding. Martini sought to hold the middle ground between Machiavellians arguing that the subjects lose all rights after the social contract, and radical ‘monarchomachs’ who believe that the ‘populus’ retains the supreme power. Martini argues that the ruler is limited by natural laws; the subjects retain rights to life and to property, but they are denied any right to resistance. Since Martini derived the monarch’s powers from the unlimited duty to guarantee security, he admitted even encroachments on religious freedom. He admitted coercion in matters that would threaten salus civitatis, but respected the inner libertas conscientiae. He also acknowledged a peculiar division of powers differentiating between a legislative, an inspectorial and an executive power. Even though the aim of this division was not a system of checks and balances, a precise description of the scope of the executive power helped to delimit a sphere of individual freedom. (shrink)

Im Gegenwind von «freier Erziehung» und Reformpädagogik entwickelte der ukrainische Erzieher Anton Semenovic Makarenko nach der Oktoberrevolution seine erzieherische Konzeption. In ihrer autoritären Form knüpfte sie an die Tradition des Zarismus an. Zugleich erkennt man darin die Vorboten der neuen Stalinschen Ära. Diese Untersuchung macht deutlich, daß sich das Phänomen des Stalinismus nicht allein aus der Person Stalins erklärt.

Idealismus und der Romantik, hat gerade in der Gotteslehre kirchliche Tradition und Gedankengut seiner Zeit zu vereinen gesucht. Seine Lehre von Gott ist getragen vom Lebensgedanken, der - verknüpft mit dem Gedanken vom absoluten Geist - die dreipersonale Lebenseinheit Gottes gegenüber pantheistischen Tendenzen sichert. Sartre und Jaspers, in welcher Beziehung stehen sie zueinander, was eint sie, was trennt sie? Jaspers- und Sartre-Forscher zeigen auf, wo das Verbindende, aber auch das Trennende liegt in der Sicht dieser beiden Denker auf zentrale Begriffe wie Existenz, Situation, Freiheit und Verantwortung.

Auch als originar politischer Denker ist Karl Jaspers reich an Einsichten: Ausgehend vom Ethos der Freiheit jedes Einzelnen richtet er seinen Blick auf die konkrete politische Gestaltung einer Freiheitsordnung. Dabei steht fur ihn im Hinblick auf die noch junge Bundesrepublik die Selbsterziehung in Freiheit im Zentrum seiner oft mahnenden Worte. Ganz im sokratischen Sinne fordert er intellektuelle Redlichkeit und politische Wahrhaftigkeit ein, um den beiden grossen Gegenwartsherausforderungen gewachsen zu sein: einer atomwaffenbestuckten Welt, die sich jederzeit selbst ausloschen kann, und (...) dem modernen Totalitarismus, der in seiner Verherrlichung des Antipolitischen allen politischen Ordnungsbestrebungen die Vernichtung androht. Jeder Frieden, der mehr ist als die Friedhofsruhe eines Waffenstillstands, grundet fur Jaspers in der politischen Freiheit handelnder Burgerinnen und Burger, die gemeinsam Sorge fur die Integritat ihres politischen Gemeinwesens tragen. There seems to be tension between portrayals of Socrates as both a committed philosopher and a pious man. For instance, one might doubt Socrates’ commitment to philosophy since he seems to irrationally defer to a daimonion. On the other hand, the fact that he challenges messages from Oracles and the gods’ role concerning the origin of the pious draws into question Socrates’ piety. In this paper, I argue that Socratic piety and rationality are not only compatible, but they are also (...) symbiotic. Socrates could not be rational without being pious, nor could he be pious without being rational because, for him, care and curiosity are intimately intertwined. In this regard, Socrates’ epistemology, when applied, resembles Karl Popper’s falsificationism. For Socrates, maintaining human wisdom amounts to regular purification of one’s belief-system. In addition, this maintenance is functionally identical to caring for one’s soul, which is morally imperative. (shrink)

Karl Jaspers war im letzten Jahrhundert - neben Heidegger -der wohl bekannteste deutsche Philosoph. Wer sich ihm heute wieder anzunahern versucht, kann jedoch leicht ratlos werden angesichts des Umfangs und der scheinbaren Disparitat seines Werks und seiner Rollen: ein Arzt und Psychologe, der Philosoph wird und zum politischen Schrift steller mutiert. Wo ist hier die Philosophie, die zu suchen sich lohnt und die das Ganze zusammenhalt? Dieses Buch, das sich an ein breiteres Publikum wendet, zeichnet den Entwicklungsgang und die (...) durchgehende Einheit von Jaspers Denken nach - von den Anfangen in Heidelberg bis hin zu seinen Basler Jahren. Die Autoren des Bandes - mehrheitlich Editoren oder Herausgeber der Karl-Jaspers-Gesamtausgabe - konnen sich dabei einerseits auf neu erschlossenes Quellenmaterial aus dem Jaspers-Nachlass stutzen, andererseits auf Ergebnisse ihrer eigenen Forschungsarbeiten. Phenomenology was in large part the discovery of Edmund Husserl, whose Logical Investigations of 1900/01 are normally regarded as the work that launched the phenomenological movement. Yet Husserl's phenomenology, in particular in the form in which it is set out in this his most important contribution to philosophy, is itself part of an Austrian philosophical tradi tion inspired by Brentano and continued, in very different ways, by Meinong, Stumpf, Twardowski, Ehrenfels, Husserl - and Marty. Like Brentano and all his heirs (...) Marty's philosophical interests were in the philosophy of mind, where this is taken to include or at least ground the philosophy of language, and analytic metaphysics. It is Marty's discussions of topics in these two areas that provide the contributions to this volume with their subject-matter. The papers by Roderick Chisholm, S. -Y. Kuroda, Barry Smith, Peter Simons, Rosaria Egidi, Karl Schuhmann, Elmar Holenstein, Edgar Morscher, Wolf gang Wenning and myself were presented at the 1984 conference on Anton Marty in Fribourg, Switzerland. Karl Philipp Moritz (1756-1793) ist bekannt als Autor des Anton Reiser und als Ästhetiker der Klassik. Heute vergessen hingegen ist der Arbeitsbereich, der ihm neben seiner Beschäftigung mit dem Schönen der wichtigste war: seine Auseinandersetzung mit der Sprache. Das vorliegende Buch zeigt Moritz als originellen Grammatiker und Sprachphilosophen vor dem Hintergrund der europäischen Geistesgeschichte. Und es beleuchtet, wie sich in den Sprachreflexionen diejenigen Denkfiguren entwickeln, die er später seiner Ästhetik zu Grunde legt: So wird das Theorem des "in (...) sich selbst vollendeten Schönen" auf die Erklärung der Verba neutra zurückgeführt, die Figur des "Gesichtspunktes] auf die Erkenntnisse über die Taubstummensprache und das zentrale Theorem der "bildenden Nachahmung des Schönen" auf die Sprachursprungshypothese. Das Buch ergänzt damit die Disziplingeschichte der Linguistik um einen eigenwilligen Sprachforscher und erfüllt, indem es Moritz' Sprachschriften in den Kontext des Gesamtwerkes stellt, eine seit 20 Jahren erhobene Forderung der Moritzforschung. Cette étude porte sur l'influence exercée par les travaux de Carl Stumpf sur la pensée de Karl Bühler. Notre hypothèse de travail repose sur le programme philosophique que Bühler attribue à Stumpf et dont plusieurs de ses travaux sont largement redevables. Notre étude est divisée en cinq parties. La première cherche à établir une filiation entre Bühler et l'école de Brentano à laquelle appartient Stumpf. Dans la deuxième, nous montrons que Bühler a pris connaissance des idées de Brentano et (...) du programme de Stumpf durant un séjour à l'Institut de psychologie de Berlin au semestre d'hiver 1904-1905, et nous commentons brièvement, dans la troisième partie, les nombreuses références à Stumpf dans l'œuvre de Bühler et deux ouvrages dans lesquels il prend la défense de Stumpf contre ses critiques. Après avoir établi la connaissance profonde par Bühler des travaux de Stumpf, nous esquissons, dans la quatrième partie, les grandes lignes du programme de Stumpf et examinons, dans la cinquième, la manière dont Bühler l'applique dans le domaine des phénomènes sensibles (gestalt). Nous concluons cette étude avec quelques remarques sur l'évaluation positive par Stumpf des travaux de Bühler. (shrink)

La distinction entre hasard « littéraire » et hasard vécu (E. Köhler) permet de dégager l'originalité du roman autobiographique de Karl Philipp Moritz. L'étude du motif du hasard dans le livre II d' Anton Reiser montre la mise en place d'un dispositif narratif caractérisé par le refoulement du traitement «littéraire» du hasard et le maintien de la perspective du hasard comme catégorie du vécu. Les hasards heureux et malheureux ne fondent pas ici la nécessité littéraire d'un destin exemplaire, (...) mais sont l'occasion d'éclairer la double détermination, extérieure et intérieure, qui affecte l'existence du personnage, vécue sous le signe de la contingence radicale. C'est dans cette obscurité première que l'analyse psychologique opère, non pour restaurer l'horizon de la Providence, mais pour dégager les leçons générales d'une existence, et donner, à ce moment, à son héros la consistance d'un personnage de roman. In this volume, Karl Ameriks explores 'Kantian subjects' in three senses. In Part I, he first clarifies the most distinctive features-such as freedom and autonomy-of Kant's notion of what it is for us to be a subject. Other chapters then consider related 'subjects' that are basic topics in other parts of Kant's philosophy, such as his notions of necessity and history. Part II examines the ways in which many of us, as 'late modern,' have been highly influenced by Kant's (...) philosophy and its indirect effect on our self-conception through successive generations of post-Kantians, such as Hegel and Schelling, and early Romantic writers such as Hölderlin, Schlegel, and Novalis, thus making us 'Kantian subjects' in a new historical sense. By defending the fundamentals of Kant's ethics in reaction to some of the latest scholarship in the opening chapters, Ameriks offers an extensive argument that Hölderlin expresses a valuable philosophical position that is much closer to Kant than has generally been recognized. He also argues that it was necessary for Kant's position to be supplemented by the new conception, introduced by the post-Kantians, of philosophy as fundamentally historical, and that this conception has had a growing influence on the most interesting strands of Anglophone as well as Continental philosophy. -/- .
